Terms of Service, Information Release & Disclosure
These Terms of Service, Information Release and Disclosure Agreement is entered into between Secunda, Inc and all related entities, “Secunda”, a Delaware Corporation with a principal place of business in Emeryville, California and the Applicant, “I”, the first and last name entered onto this Candidate Application, for the purposes of evaluation to join the Secunda program. This Agreement is accepted as of the date of application submission.
Protecting your private information is our priority. This Statement of Privacy applies to the Secunda program and related entities.
Information Release & Disclosure: I understand that Secunda is a program specifically designed to help those with criminal records to succeed. As part of that program, Secunda refers applicants to qualified employers and helps the applicant to obtain a quality job. Secunda may also coordinate necessary resources with numerous support organizations including, but not limited to, reentry nonprofits or entities, support or recovery groups, houses of worship, training or other programs. In order to effectively coordinate such services, Secunda may release information I have provided to (A) potential employers or (B) support organizations or individuals (including “Champions” /mentors). I, the Applicant, voluntarily consent to Secunda to disclose any and all information for which I have provided for which Secunda deems necessary or helpful, that I have or will provide to Secunda to the extent permitted under applicable federal, state, and local law. Secunda takes all measures to abide by all applicable laws on disclosure. In compliance with these laws, much of the personal information asked by Secunda will never be shared with potential employers while other information will not be available to a potential employer until after a conditional offer of employment is made. Please inquire if you have any questions about what information may be disclosed.
Consent for References and Reference Disclosure: I hereby authorize any references I have or will provide to Secunda to disclose in good faith any information they have regarding my qualifications and fitness for employment or for participation in the Secunda program. I additionally consent to Secunda, in its discretion, calling additional references or organizations that may be able to speak to my character or background. I will hold any and all such references, whether provided to Secunda or contacted by Secunda on its own volition, and any other persons speaking on behalf of references free of liability for the exchange ofthe information they provide and any other reasonable and necessary information incident to the Secunda program application and participation process or relevant to Secunda’s program evaluation. I further consent to the release of any information provided by my references to potential employers to the extent deemed necessary or appropriate and provided that such disclosure is consistent with applicable law.
Interview Recording: I understand that Secunda may record interviews for internal program related evaluation purposes. I hereby consent to the recording by Secunda of all interviews conducted in connection with my application to and, if accepted,my participation in the Secunda program.
Additional Data Disclosure & Communications: By applying to the Secunda program, I understand and agree that that Secunda may contact me on behalf of its program or external partners of programs that may be of interest or may be valuable. In those cases, I authorize Secunda to release my unique personally identifiable information (name, email, telephone number, and/or address) may be provided to third parties with the goal to provide related services to me. Secunda may share data with trusted partners to the extent permitted by applicable law in order help perform statistical analysis, send me email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using or disclosing personal information except to provide these services to Secunda, and they are required to maintain the confidentiality of your information.
I acknowledge that Secunda may disclose my personal information, without notice,if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Secunda ; (b) protect and defend the rights or property of Secunda;and/or (c) act under exigent circumstances to protect the personal safety of users of Secunda, or the public. If required by law or mandated by courts or if deemed to be a risk to myself or others, Secunda may disclose necessary personal information.
Data Storage: Secunda may store your data on servers provided by third party hosting vendors or contract with 3rd party professional services for which it has to transact your personal information in the U.S. and internationally.
Changes to this Agreement: Secunda reserves the right to change the terms of this Terms of Participation Agreement from time to time. Secunda will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our site, and/or by updating any privacy policy information on this page. Your continued use of the Site and/or Services available through this Site after such modifications will constitute your: (a) acknowledgment of the modified Privacy Policy; and (b)agreement to abide and be bound by that Policy.
Release of Liability: As consideration for the opportunity to participate in and receive the benefits of the Secunda program, I hereby release, waive and discharge Secunda, its officers, employees, agents, partners,affiliates, volunteers, or any other related representatives, from any and all liability, claims, or causes of action arising out of or in any way connected with my application and participation,if accepted, in the Secunda program, or upon Secunda’s acts or omissions,whether negligent or not ("Waiver"). I agree to this Waiver on behalf of myself, my heirs, executors, administrators and assigns.
As further consideration for being allowed to participate in the Secunda program, I hereby agree, on behalf of myself, my heirs,executors, administrators and assigns, to indemnify and hold harmless Secunda, its officers, employees, agents, partners, affiliates, volunteers or any other related representatives, from any and all claims for compensation, personal injury,property damage or wrongful death caused by my negligence or willful misconduct, in any participation of Secunda.
Arm’s Length Agreement. This Agreement and each of its terms are the product of an arm's length negotiation between the Parties. In the event any ambiguity is found to exist in the interpretation of this Agreement, or any of its provisions, the Parties, and each of them, explicitly reject the application of any legal or equitable rule of interpretation which would lead to a construction either "for" or"against" a particular party based upon their status as the drafter of a specific term, language, or provision giving rise to such ambiguity.
Enforceability. The invalidity or unenforceability of any provision of this Agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Agreement or of any other applications of such provision, as the case may be,and such invalid or unenforceable provision shall be deemed not to be a part of this Agreement.
Dispute Resolution. The parties will attempt to resolve any dispute arising out of or relating to this Agreement through friendly negotiations amongst the parties. If the matter is not resolved by negotiation, the parties will resolve the dispute using the below Alternative Dispute Resolution (ADR) procedure.
To the extent permitted by applicable law, any controversies or disputes arising out of or relating to this Agreement will be resolved by binding arbitration conducted before a single arbitrator which will take place in Alameda County, California under the streamlined arbitration rules of JAMS. The arbitrator's award will be final, and any judgment may be entered upon it by any court having proper jurisdiction.
I acknowledge that applying to the Secunda program is entirely voluntary and that I willfully, under no obligation, pressure or duress, to enter into this Agreement. I certify that all information that I have provided in the application and that I will provide is accurate and understand that if any information provided to Secunda, its representatives, or partner organizations is falsified at any time I may be dismissed from the Secunda program and such falsification and status may be disclosed to Secunda’s related partners. I understand that this Agreement does not guarantee any services nor extends any offer of employment. At no time do any services that Secunda provides constitute legal advice.

We can help with everything from interview preparation to coordination of any support services you need to be successful in your new job.We offer access to some of the best resources, in addition to partnerships with numerous reentry organizations to help you get ahead.
· Your own Champion whose walked in your shoes. For the first 90 days of employment, you’ll select a “Champion” through our mentorship program. Each individual has been where you’ve been, achieved success, and can be a sounding board for whatever you need. Champions are spread across the country an,d in addition to weekly video calls, you can text / ask questions or use them for whatever you need. If you’ve had a hard day and want to chat or have a transportation question that you don’t want to ask anybody – they’re there when you need them.
Our Expectations of You:
If accepted into the Secunda program, we make an significant investment into shaping your success. To move forward with the application process, we need to know that if accepted into the Secunda program, you will meet the following requirements (please check off each to acknowledge acceptance):
ü I commit to completing the Secunda interview process including multiple Secunda interviews, an online assessment, reference checking, and interviews with an employer I’m referred to.
ü I attest that I have not been an active member of a gang for the previous 12 months from the date of this application. I renounce all gang affiliation now and indefinitely.
ü If I accept a job with an employer Secunda refers me to, I intend to remain in that job for a minimum of 1 year (employers we refer you to invest in training and career development).
ü If I accept a job with an employer Secunda refers me to, for the first 90 days, I agree to be paired with a “Champion” (peer coach who has walked in my shoes, been successful, and can be a personal adviser). I commit to weekly video calls at my convenience with the Champion.
ü If I am accepted into the Secunda program, I commit to maintaining active membership with a community organization of my choosing. This could be a reentry organization, training organization,community support group, house of worship, service-oriented program, or similar activity.
ü I commit to the values of the Secunda program:do honest work, be punctual and live up to my commitments, lead by example, and be a standup citizen obeying all federal, state, and local laws.
ü The Secunda community believes we’re stronger together and in the importance of paying it forward. If accepted, I intend to continue to pay it forward to help other returning citizens and the Secunda community.
I, the Applicant, accept all the Secunda program expectations listed above and wish to be considered for the program. I understand that this program is voluntary. I acknowledge that as part of Secunda’s program it may refer me to employers. However, Secunda is not an employer, has no role or responsibility in the hiring decisions of such employers, and disclaims all liability for such hiring decisions or employment. Secunda makes no offer of employment directly for itself or any participating company.
